Nautical Equipment Rental
1. General Terms and Conditions
1. This regulation defines the conditions and responsibilities of clients who rent sports equipment from FeelViana – Hotelaria LDA , hereinafter FeelViana Sport Center or Rental Company .
2. All equipment is the property of FeelViana Sport Center and is intended exclusively for its intended regular use.
3. It is the customer's responsibility to read and understand this contract before renting.
4. Liability and accident insurance is provided for all equipment.
5. The client declares to be over 18 years of age , to be in good physical condition, to swim competently (when applicable), and not to be under the influence of alcohol or drugs, nor pregnant or with injuries that compromise their safety.
6. All rentals are at the customer's own risk , who agrees to use the equipment to the best of their ability and with proper technique.
7. No refunds – no refunds will be given for unused rental time.
2. Rental Period
The rental period begins when the equipment is handed over ( check-out ) and ends when the equipment is returned and inspected ( check-in ).
The equipment must be returned only to the rental location's staff during business hours.
Late returns will incur additional fees, as per the current fee schedule.
Failure to return the equipment may result in a criminal complaint for theft/robbery and retention of the deposit.
3. Use and Care of the Equipment
The customer agrees to use the equipment diligently, prudently, and safely.
Commercial use or transfer to third parties not identified in the contract is prohibited.
Equipment subject to mechanical failures must be reported immediately to FeelViana Sport Center.
The customer is responsible for any partial or total damage, loss, theft, or robbery of the equipment, calculated based on the retail price less a 20% reduction (VAT included).
If the equipment is booked for subsequent days, the customer may have to pay €20 per day for equipment immobilization.
4. Personal Data
FeelViana Sport Center uses personal data to provide rental services and improve the customer experience.
The data may be shared with authorities or third parties for the management of complaints, collections, and investigations, in accordance with the law.
The customer has the right to access, correct, or delete their personal data.
5. Lost and Found
Personal belongings found will be kept for 3 months; items containing sensitive data will be deleted after 28 days.
6. Subsection: Nautical Equipment (Surf, SUP, Windsurf, Kitesurf, Wing)
The customer declares to be familiar with the safe use of each piece of equipment and accepts the risks involved.
Equipment provided:
Surf : surfboard and leash
› SUP : board, paddle, life jacket and helmet
Windsurfing : board, sail, mast, boom/base, vest and helmet optional
Kitesurfing/Winging : board, kite/wing; vest and helmet optional.
Class conditions : In case of a delay exceeding 20 minutes ( NO SHOW ), the class will be considered as completed.
If there is no wind or waves, alternative equipment or experience will be offered, with no refund.
7. Subsection: Bicycles
The customer declares to be familiar with the safe use of bicycles.
Road bikes: helmet and quick repair kit provided.
Mountain bikes: helmet and quick repair kit provided.
It is forbidden to use bicycles on the beach ; violations will result in a €500 fine.
Rescue Bike service available upon request and subject to availability.
8. Changes and Additional Costs
Changes to the rental period will incur additional charges.
Damage to or loss of equipment will result in compensation as per the previous clauses.
The client is responsible for any costs incurred by other users they have referred.
9. Payments
Payments can be made by credit card or cash.
For hotel guests, the amount can be charged to their room.
Currency other than the Euro will be converted based on the Bank of Portugal's rate of 4%.
10. Forum
For any disputes, the competent court is the district of Viana do Castelo , with express waiver of any other jurisdiction.
11. Final Declaration
I, the undersigned, declare that I have read and understood this contract, accepting all its terms and conditions.
I authorize the use of my image for promotional purposes of FeelViana Sport Center.
